THE State has urged the Constitutional Court to dismiss the petition linked to the removal of three of its judges, who “grossly misconducted” themselves.

It has submitted that the President rightfully removed the judges and that evidence against them was that the trio was not qualified to hold office.

The State has further argued that the petitioners’ contention that the Judicial Complaints Commission (JCC) panel which recommended the removal of the three judges never formed a quorum and was ill qualified, is misconceived.

“The respondents, therefore, pray that this petition should not be allowed and that the members of JCC are qualified to hold judicial office,” the document reads.

Constitutional lawyer Tresford Chali has argued that the JCC overstepped its bounds in recommending the removal of judges Palan Mulonda, Mungeni Mulenga and Anne Sitali.
