THE Court of Appeal has ordered a retrial in the case of a 48-year-old man of Siavonga sentenced to death for allegedly murdering his wife after axing her on allegations of infidelity.
Judge Yvonne Chembe, alongside a panel, determined that the testimony provided by the couple’s 14-year-old daughter lacked the required voir dire assessment.
Voir dire is a legal process used to assess the credibility and reliability of a witness’s testimony, particularly witnesses who may have special circumstances, such as juveniles.
Solvent Gama, 48, was charged with murder after it was alleged that on December 30, 2021, he hacked his wife, Rosiah Malimbika, 43, to death.
