UNITED Party for National Development (UPND) secretarygeneral Batuke Imenda’s lawyers want the case in which their client is charged with use of hate speech referred to Constitutional Court.
The lawyers want the higher court to determine constitutional issues raised in the case, which has been filed in Magistrates Court through a complaint by Patriots for Economic Progress (PeP) president Sean Tembo.
In their constitutional issues, the defence lawyers are challenging the continued appearance of Mr Imenda before Lusaka Magistrates Court when the Director of Public Prosecutions (DPP) has not issued instructions for prosecution of the matter.
