Stardy Mwale forfeits $2.5m farm

THE Economic and Financial Crimes Court (EFCC) has ordered the forfeiture of former Ministry of Defence Permanent Secretary Stardy Mwale’s US$2.5 million farm to the State because the asset is a proceed of crime.
Apart from forfeiture of Simonga Farm 132a, located in Mazabuka, a three-member bench also condemned Mr Mwale and three other interested parties in the case to costs.
The court ruled that based on its detailed analysis, it was of the well-considered view that the applicant, Anti-Corruption Commission (ACC), had established on the balance of probabilities that the farm is tainted.
“The property is liable to forfeiture as envisaged under the Forfeiture of Proceeds of Crime Act No. 19 of 2010,” Judge Susan Wanjelani read the judgment on behalf of judges Ian Mabbolobbolo and Vincent Siloka.
“Accordingly, we order that the Simonga farm be forfeited to the State.”
