Charms, forced sex and emotional abuse lead to divorce

A WOMAN testified in the Matero local court that her husband forced her to have sex throughout the night, even when she was menstruating.
Vyness Moyo, 27, who has been on separation from her husband for the past 11 months complained that her husband would also force her to take concoctions and put charms on her side of the bed.
“That was the reason I left my matrimonial home because he was forcing me to have sex even when I was bleeding (periods).
Before putting the charms on my side of the bed, my husband forced me to take unknown concoction on two different occasions,” Moyo said.
“Your honour, my husband has been forcing me to take charms and after refusing to drink some concoctions on two different occasions, he secretly hid charms on the side of the bed. Afterwards, I started having prolonged periods. Despite this condition, he forced me to have sex with him the whole night,” Moyo said.
She said she has never known peace in her marriage because the first few days after she got married, her husband started sleeping with other women.
“My husband would also give my mobile phone number to his mistresses so that they can call, insult and mock me. I have been staying on my own with my son since I left the matrimonial home 11 months ago,” she said.
Moyo, however, begged the court not to grant divorce as she was still in love with her husband.
But Muleya denied putting charms on his wife’s side of the bed which led her to having prolonged periods.
“I only used to ask her to boil a concoction for me which was meant to increase my libido, strength and sexual appetite,” Muleya said.
He also told the court that he was no longer interested in his wife because she threatens to kill
him. He said he fears for his life.
“I don’t want this woman anymore, this is because she threatens to stab me with a knife or pour hot cooking oil on me while I am sleeping, so I don’t want her,” he said.
In his judgement, magistrate Lewis Mumba noted that it was not in dispute that the complainant put charms on the side of the bed where his wife sleeps because she had produced evidence in court.
The court noted that Muleya does not respect his wife by giving her mobile phone number to his girlfriends so that they call and insult her.
“Claim is upheld and divorce granted. Muleya will compensate his wife with K6000 to be paid in instalments of K1000 monthly. Muleya is also ordered to be maintaining your child with K500 monthly. Property acquired together to be shared equally,” the court ordered…
